When purchasing from Håland Instrumentering AS
1. Quotations
Quotations are only binding within the specified time limit.
An agreement is not concluded until the seller’s order confirmation is available.
For stock items, reservations are made for intermediate sales.
2. Calculation of prices
The prices are understood to be freely delivered to the seller’s warehouse, excluding VAT, excise duty or other public charges.
They are based on the seller’s supplier prices, as well as exchange rates, customs duties and taxes applicable at the time of entering into the agreement.
We reserve the right to adjust prices as a result of changes in exchange rates, customs duties or taxes in excess of 2.5%.
However, such adjustments shall not be made after the buyer’s payment has been received.
Small exchange rate changes of less than 2.5% shall not result in a price adjustment.
3. Delivery
The stated delivery time is based on information from the seller’s suppliers, and the seller undertakes to do what it can to ensure that the delivery time is complied with.
Delayed delivery alone does not give the buyer the right to cancel the contract or claim compensation.
If the buyer cannot receive the goods at the agreed time, storage will be arranged at the buyer’s expense and risk.
The seller may demand settlement in accordance with the sales agreement as if delivery had taken place.
Where structural conditions make it necessary to use extra crew and/or equipment for delivery, this will be at the buyer’s expense and risk.
4 Delivery terms
All shipments are delivered Ex Works (EXW) or FCA Stavanger area.
5. Sales pledge
Until the goods have been paid for in full, the Seller has a pledge (sales pledge) on the item sold as security for its claim to the purchase price plus interest and costs.
The buyer must therefore treat the item in accordance with this condition.
6. Installation
Installation, commissioning and instruction are not included in the price, but can be offered on request.
In the event of out-of-town installation, travel costs, accommodation, per diem and travel time will be charged.
Necessary electrical installation, water and gas shall be arranged in advance by the buyer at no cost to the seller.
7 Payment terms
Payment must be made net within 30 days of the delivery date.
In the event of late payment, interest in arrears will be charged.
Cash on delivery can be used for new customers or customers who are not yet credit approved.
8. Complaints
Upon receipt, the buyer must inspect the goods and complain about any obvious defects within 8 days.
Otherwise, acceptance of the complaint cannot be expected.
Claims for defects that can only be discovered after assembly and test driving must be made immediately after the defect is discovered.
9. Warranty
The Buyer’s right to complain only covers damage caused by manufacturing and material defects.
The right of complaint lapses 12 months after the delivery date, but a shorter complaint period can be agreed.
The Seller undertakes to carry out free repairs and replacement of defective parts at its main workshop during ordinary working hours.
If the Buyer wishes repairs to be carried out at the Buyer’s premises, travel costs, accommodation, per diem and 70% of travel time spent will be charged based on current repair rates.
The right to complain lapses if connections or interventions have been made to the item without the seller’s consent, if damage occurs as a result of inexpert or improper treatment and inadequate maintenance and if the terms of payment have not been met.
Parts such as gaskets, hoses, lamps, fuses, simple electronic components, etc. are considered consumables and are either wholly or partially excluded from warranty.
10. Repairs
Repairs after the expiry of the complaint period shall be paid for in full by the Buyer. Shipment to and from the seller’s workshop is thus at the buyer’s expense and risk. If the repair work is carried out at the buyer’s premises, the buyer shall cover travel costs, accommodation, per diem and travel time in addition to the working hours used. The right to complain, which does not exceed 3 months after the repair has been carried out, is limited to only the defect that is sought to be corrected. The defect in the performed repair work must be demonstrated by the buyer. Other faults or defects that arise are not covered by the right of complaint. In the event that the seller is able to provide a spare appliance during the repair period, the buyer shall pay shipping and insurance as well as a weekly rent.
11. Liability
The seller undertakes to deliver faultless, functional goods in accordance with the applicable technical specifications (see also section 8).
If this is not the case, the seller shall be given a reasonable period of time to put the equipment in the prescribed condition.
The seller disclaims liability for any damage or loss caused directly or indirectly by defects or deficiencies in the goods, unless the seller has shown gross negligence.
Liability will in that case be limited to 10% when the price of the goods does not exceed NOK.

12. Cancellation
A binding purchase agreement is concluded when the seller has confirmed the buyer’s order.
The agreement can only be changed or terminated with the seller’s consent.
13. Returns
Returns of purchased equipment can only take place with the seller’s consent and are at the buyer’s expense and risk.
Returned equipment is credited with up to 80% of the sales value for standard stock items in unused or unused condition or with lower rates at the seller’s discretion for used or second-hand equipment.
14. Exceptions
These general terms and conditions apply to the extent that they are not deviated from by written agreement.
